Human Resources Constructive-Dismissal Report Essay

Message It has come to my unfortunate attention that a former employee has made a discrimation-focused legal claim against our company. My goal is to define â€Å"constructive dismissal†; explain the legal mandates to which it may be attributed; discuss the merits—or lack—of it; and offer future mitigative actions to avoid such claims. Constructive Dismissal—Defined Before delving into a serious discussion of the former employee’s claim, it is important to understand the legal construct upon which it has been founded; this construct is referred to as â€Å"constructive dismissal.† Constructive dismiissal refers to an employee compulsion to terminate any working relationships with an employer. The impetus for the termination is an employer’s willful intent to create a hostile or unbearable working condition. Legally speaking, constructive dismissal is, then, tantamount to involuntarily separating the employee from the company (United States Department of Labor, 2012). There are three standards that must be considered when adjudicating whether a situation falls within constructive-dismissal grounds. They are 1. Intolerable Conditions 2. Objective Standard 3. Employer Knowledge and Intent The adjective in the first standard is important, because it makes the distinction between undue working conditions that are unbearable for a reasonable person and a process change that may be inconvenient for the  employee but is not intolerable. Trival matters such as changing a computer from a PC to a Mac, are exmempt from this standard, since these frustrations are a normative in all areas of employment. The second standard establishes a consensus on what is considered intolerable. It is defined as a work environment in which a reasonable person would feel compelled to quit. The third standard is also important, because it clearly indicates that the employer must know that changes that it is implementing create an intolerable environment, and it does so with the intent of compelling an employee to quit as opposed to implementing changes that are motivated by a substantiated business need (Turner v. Anheuser-Busch, Inc., 1994). Please note that constructive dismissal does not necessarily imply discrimination (though it is almost always discrimination based), since it can apply to both those in a protected class or outside it. The ex-employee charges that the schedule change for the production department was an unreasonable action on the company’s part and resulted in her being forced to work on a holy day of her religious persuasion. Resultantly, she charges that she felt compelled to quit, which is why she has filed a constructive-discharge claim against the company. Constructive-Dismissal and Attendant Legal Mandates More than just creating such a toxic environment, when the working condition creates an undue effect based on the employee’s race, ethnicity, gender, national origin, or religion. the Title VII of the Civil Rights Act applies and sets forth: â€Å"(1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such indviduals’race, color, religion, sex, or national origin; or â€Å"(2) to limit, segregate, or classify his employees or applicants for employment in any way which woulld deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, religion, sex, or national origin† (Equal Employment Opportunity Commission, 2012). An amalgamation of undue effect and discrimination of a protected class engenders â€Å"disparate impact† (Equal Employment Opportunity Commission, 2012) Employment separation due to disparate impact explicitly applies to the following sections of Title VII of the Civil Rights Act of 1964. The onus of proof is placed on the claimant. This person must do the following:  Ã¢â‚¬Å"(i) a complaining party demonstrates that a respondent uses a particular employment practice that causes a disparate impact on the basis of race, color, religion, sex, or national origin and the respondent fails to demonstrate that the challenged practice is job related for the position in question and consistent with business necessity; or â€Å"(ii) the complaining party makes the demonstration described in subparagraph (C) with respect to an alternative employment practice and the respondent refuses to adopt such alternative employment practice. â€Å"(B) (i) With respect to demonstrating that a particular employment practice causes a disparate impact as described in subparagraph (A)(i), the complaining party shall demonstrate that each particular challenged employment practice causes a disparate impact, except that if the complaining party can demonstrate to the court that the elements of a respondent’s decisionmaking process are not capable of separation for analysis, the decisionmaking process may be analyzed as one employment practice. â€Å"(ii) If the respondent demonstrates that a specific employment practice does not cause the disparate impact, the respondent shall not be required to demonstrate that such practice is required by business necessity. â€Å"(C) The demonstration referred to by subparagraph (A)(ii) shall be in accordance with the law as it existed on June 4, 1989, with respect to the concept of â€Å"alternative employment practice†. â€Å"(2) A demonstration that an employment practice is required by business necessity may not be used as a defense against a claim of intentional discrimination under this subchapter. â€Å"(3) Notwithstanding any other provision of this subchapter, a rule barring the employment of an individual who currently and knowingly uses or possesses a controlled substance, as defined in schedules I and II of section 102(6) of the Controlled Substances Act (21 U.S.C. 802(6)), other than the use or possession of a drug taken under the supervision of a licensed health care professional, or any other use or possession authorized by the Controlled Substances Act [21 U.S.C. 801 et seq.] or any other provision of Federal law, shall be considered an unlawful employment practice under this subchapter only if such rule is adopted or applied with an intent to discriminate because of race, color, religion, sex, or national origin† (Equal Employment Opportunity Commission, 2012). Although constructive dismissal is not directly referred to in the Civil Rights Act, it is clearly implied, since such a dismissal normally is directed at protected classes of individuals. When combined with disparate impact, constructive dismissal will fall under the purview of the Civil Right Act, and both are legally actional behaviors that the federal government will pursue through legal action and fines. It should be noted that the level of requisite integrity of constructive-dismissal claims can vary from state to state. For example, Washington extends a protected-class status to gays, lesbians, bisexual, transgender, or intersexed people, whereas Arizona extends no special class status to them. A constructive-dismissal claim due to sexual orientation in Washington would be considered; in Arizona, such a claim would not be considered. Furthermore, such a claim would face significant challenges if  appealed to federal levels, since federal laws offer no protection against discrimination based on sexual orientation (Human Rights Campaign, 2012). In addition to constructive dismissal, the ex-employee charges that the schedule change infringed on her right to practice her religion, since she believed that she was required to work on a holy day. The Title VII Act explicitly prohibits discrimation based on religious affiliation. Constructive-Dismissal Merits The ex-employee’s claim does not satisfy constructive-dismissal, disparate-impact, and discrimination prohibitions. The facts of this case clearly indicate this. Let us apply this individual’s claim to the standards required for each prohibition. First, for constructive dismissal, our company must create a hostile environment for the sole purpose of compelling the employee to quit. The ex-employee believes that the schedule adjustment, which required 12-hour days for four days a week and with three days off, created a hostile environment. This particular aspect of this individual’s claim fails this test for a few reasons: 1) Business growth motivated the schedule adjustment, not malice; 2.) the schedule adjustment applied to the most affected department, which is production, since it is tasked with keeping up with the increased demand for our products; and 3.) we provided employees of that department schedule options; we did not constrain them to work on specific days that happened to be days of observance for their religion. Considering the schedule flexibility offered, if the ex-employee worked on a holy day, it was out of choice, not compulsion on the part of our company. Another implication in the above argument is that a different department did not have its schedule adjusted. As indicated above, we adjusted the schedule for the department that is directly affected by the business growth—the production department. There is no impetus for us to adjust schedules for the human-resources department, for example. Second, for objective standards, courts have repeatedly ruled that constructive dismissal is applicable if we create an environment that is so heinous, a reasonable person would quit. I have just indicated that our schedule adjustment was motivated by business need, not malice toward a particular individual or religion. All of the other employees took advantage of the schedule opportunity offered and chose days to work that were appropriate for their needs. There have been no other complaints of being forced to work or being unable to work on a non-holy day. Based on the scenario, it would not be reasonable to quit one’s job. Third, for employer knowledge and intent, it is true that we knew that the increase in business might have caused an impact on certain employees’ lives. We proactively remedied this situation by offering such a flexible schedule, with employees making their own choice of what days they would and would not work. Employees have nearly half their workweek off. There is no reason for an individual to work on a holy day. Also, our only intent was to meet our customers’ needs, so we adjusted our business processes to effectively do so. The underlying concern is that our actions were motivated by this individual’s religion. There is no tenable evidence to support such a concern. We hire a range of people with different religious beliefs. Some are unwilling to work on Sundays. Others are unwilling to work on Saturdays. Some require prayer at various points during the day. Where reasonable, we have always provided accommodations for such observances, and we did so with our schedule adjustment. There was no targeting of any religion. There is no veracity to the ex-employee’s claims. The company must respond to these charges. It can do so in one of three ways: 1. The company can ignore the facts of this scenario and accept that the ex-employee’s claims have merit and can then move to placate the ex-employee in a few ways: a. Rehiring the ex-employee and paying her retroactive pay for the time she did not work, b. Not rehiring the ex-employee but  offering a settlement to avoid a protracted legal scenario, or c. Rehiring the ex-employee and accommodating her schedule requests (Palopoli, 2011). 2. The company can enter into arbitration with the ex-employee to discuss the facts of the scenario, with the intention of arriving at an equitable solution that will placate the concerns of the ex-employee and the company (EEOC, 2012). 3. The company can refute the charges in a court of law, especially after the findings of an investigative company effort denote no actual discrimination or the appearance of it (Cruz, Padilla, & Narvae Law Firm, 2011). There are caveats to each of these responses, however. For Response 1, this action is a clear company admission of its culpability in discrimination within its organization. It is an unbalanced response, since it placates the ex-employee but tarnishes the name of the company. Furthermore, acquiescing to the ex-employee’s claims by adjusting the schedule may very well set an inappropriate expectation for other employees. An influx of schedule requests based on employees who invoke their religious preferences would thwart the purpose of the schedule request, which is to meet customer demand. For Response 2, the results of an arbitration hearing are legally binding and normally are a mitigative step against taking up the matter in a court of law. There is a likelihood, no matter how remote, that arbitration will result in our company’s acquiescing to the ex-employee’s claims. This eventuality can result in financal loss due to paying exorbitant sums to the ex-employee for what would amount to silencing her criticism of our company. Or if the results of the arbitration fall in line with the company’s wishes, the negative image that the ex-employee may generate would harm recruiting efforts of candidates or customers who increasingly place value on companies that demonstrate social responsbility toward people and its surroundings. For Response 3, the judgment in a legal case can be binding. There may be a remote possibility that our company may not vindicate itself fully in court. Because of the facts of the case, it would be reasonable to expect that our company would appeal. However, the cost to contend with the ex-employee in court may be prohibitively high. And even if our company emerges victoriously, the result would not constrain the ex-empoyee from tarnishing our company’s name in the marketplace. Based on the eventualities listed above, the viable course of action is Response 3. The actions of our company are sufficiently supported to provide a solid response in a legal setting. The likelihood of not prevailing in court is minimal. And although the opportunity cost to following this route is devoting funds unnecessarily to a baseless claim, vindication in court may very indicate to others who choose to bring dubious claims that our company will respond indignantly to these affronts to our company’s reputation. Responding to the baseless claim by pursuing the matter in court is a tenable position, since our anti-discrimination policy is clear. (In allusion to a subsequent section, the clarity of the policy does not imply that it has been adequately explained to prosepctive and current employees; a training program offered to our recruiting staff will resolve that matter.) Our greatest defense is in presenting this policy as evidence to the court. The policy clearly indicates that the company respects religion as a protected class and makes every effort to accommodate religious rites as long as they do not present an undue contravention of company operation (HR Info Center, 2009). A court-centered legal response to this claim is preferable also because of the investigative process that is extant within our anti-discrimination policy. The ex-employee did not provide our company an opportunity to investigate the claim before she resigned her position. The only indication that a problem existed was when the EEOC delivered the complaint to our company. Our investigative processes clearly demonstrate the thoroughness  and seriousness that our policy devotes to discrimination complaints. Multiple layers of leadership are involved in the process, and many employees are interviewed to determine if they shared the same sentiments. The investigative process is also confidential, and the results are shared with no entity without a need-to-know basis. Furthermore, the investigative process has corrective action built in if there is a determination of discrimination against the employee making the complaint. It also has a built-in anti-retaliation policy, regardless the result of the complaint. Our company can provide documented evidence of our response to past complaints as well as the company’s disposition toward employees after the resolution of these complaints. Demonstrating the company’s follow-through efforts that the ex-employee did not avail herself of will provide substantial support of our contention that we are committed to operating in a discrimination-free environment (Kleiner Perkins Files Legal Response To Gender Discrimination Suit, Denies â€Å"Each And Every Material Allegation, 2012). Another reason why pursuing this matter in a court of law is appropriate is that our company can demonstrate our commitment to investing in the community in which we operate, a diverse community. Our company currently provides several millions of dollars in tax revenue to the community, revenue from which all members of the community benefit. But more than tax revenue, our company provides financial support to various groups in the community: religious-based groups, gay-and-lesbian groups, black-focused groups, and women-centered groups. Our commitment to financially supporting the community is a potent response by itself to the baseless claima against us. Logically speaking, it would be nonsensical for our company to expend money for these community-focused endeavors while practicing discrimination against the very members of the groups that benefit from our financial support (Response to discrimination claims, 2007).

There was all the animals above in the Galun'lati, the sky realm. They wanted more space and wondered what was below the water. The little water-beetle voluntered to seek what was below.He darted for every direction, but no firm place to rest. He went down under and gather mud, which ended up growing on every side until it because as to what we know call Earth. The animals were anxious to go down, they asked the birds to check if it wasn’t too wet and they said that it was still wet. Later, the Buzzard went down, he flew all other and got ve ry tired and his wings began to strike the ground making what we call moutains and the animals thought there would only be mountains so they called the Buzzard to come back. As it dried, it grew dark so they got the sun and set in a track to go around everyday at a specific time.They took the sun, but it was really hot so they pushed it a little further until it was the right temperature for them to look around. Under this newly found earth was another – where plants grew and seasons were different. There were streams that came down the mountains. When the season would change the water grew warmer and warmer in the fall and in the winter things grew colder and colder. When the plants and animals were made they were told to watch and keep awake for several nights and only the owl, panther and one or two were given the ower to see and to go about in the dark and made the prey of birds and animals to sleep at night. As for the trees, it was the ceder, pine, spruce, holly and the laurel who were given to be always green and to be greatest for medicine. The rest had to lose their leaves every winter. There was only one boy and one girl until he struck her a fish and said to multiply and so she did, but very rapidly that they feared that the world wounldn’t keep up and then so it was made that a women should only have one child a year and so it has been ever since.

There is really no point of trying to negotiate something that the company cannot afford thus it is very important to learn more about the company’s financial status when negotiating for salaries. Counter offers are better set in writing so that the other party will know for certain what the stand of the other is. I do believe that language is changed by thought. After all it is the mind that is the one that thinks of the sentences and its thought that may corrupt the language. After all language does not write it self on a paper. The mind can basically create any thing with language. This is why every thing works in theory. But practically it doesnt. I do believe that man creates language to express our selves. Some might use it to corrupt other thoughts but isnt that why language is there. So we can understand each other and express our feelings, thoughts and to claim things, even though they are not true. Language according to the oxford dictionary is defined as: Language noun 1.Words and their use. 2.The words used in a particular country or by a particular group of people [from the Latin lingua=tongue] In a different dictionary it says that language is the system of human expression by means of words. Human language, as expressed by the voice, depends for its production on certain physical characteristics, which are not possessed by the apes. The left hemisphere of the human brain dominates comprehension and expression of written and spoken language. This might be  far searched but maybe this is why communists who believe in all things are equal are called the left wings usually. They are the ones who want to control every thing in life so maybe that is why they are called the left wings. There are more than 5000 languages, or dialects, which are classified in families, though the relationships are not all well established. For example, with a few exceptions, e.g. Basque, Finnish, and Tamil, all the languages of Europe and India belong to a single much diversified Indo-European family. Computers (using rules of language structure) can now translate technical documents with an 80%accuracy. This just shows the diversity of the modern technology. One problem with translating is that different people interpret the text differently. There have been experiments in Nevada USA to see if chimps have the same ability of creating languages that we understand, the scientist figured that since we where related that this could be possible, they found that chimps are not able to produce the human sounds. So at the moment humans are the only ones that have a language. It might be that other animals have languages as well. But the humans have yet to discover this. It has been discovered that animals do have some sort of communication but we cant yet speak dog or cat. Language can corrupt thought as well. A great example is the novel nineteen eighty-four. As part of a great totalitarian state the government creates one language, newspeak, where no emotion words are in the dictionary. With newspeak there is no way of expressing the true emotions, like hate towards Big Brother or love towards one and other. It is possible to disagree with the party by using double negation, or making up words. But the characters in the novel are to scared to do so, because if they do they are committing the act of thought crime, and for that they could be vaporized or worse. Communists set up the whole idea of Big Brother. So as mentioned before this might have to do with the fact that those people want to restrict the growth of the left hemisphere of the brain, as this is the part that lets us speak and write language. They probably want to restrict all things because that  would cause opposition to the party. This might lead to the political party to loose their power or sharing their power. This is something they want to avoid if they want to become a totalitarian state. The opposition might spoil that for them. I wonder in the future if the world will in a way become some thing like Big Brother. One language, every one alike and no one is allowed to be different. What a boring place that would be. I can imagine that one day the world would have one language so would avoid confusions in politics and this would make traveling much easier. Also a students life in high school would be so much easier if you did not have to learn three or four different languages. But language comes along with identity. Going to a different country and hearing a different language is something that might not be any more in the future. We might all be speaking English or a new language like newspeak might be introduced. Maybe the countries might keep their own language but that every country might have that universal language as a second language. But coming back to the point if thought corrupts language, language can also corrupt thought, I do think that language can easily corrupt thought. Not to one self but if lets say, I tell you that the word believe has been taken out of the dictionary and you believe me and immediately tell all your companions this might cause a great confusion about language. I would be the one who spoilt the language, because what word could you use to replace believe? Synonyms of believe are: (according to oxfords Thesaurus.) accept, be certain of, be convinced of, count on, assume, conjecture, consider, gather, and guess. All of these words might be the same, but they cant really replace believe, because as all words, believe has a unique meaning that cant exactly be replaced. In conclusion to ascertain as to if thought corrupts language, language can also corrupt thought, I totally agree. But I dont take the statement as serious as George Orwell does. He gives many examples of bad writing in the essay Politics and the English language, but I think I speak for everyone that one of those examples we use in our language every day. Does this make  us bad writers? According to Orwell we are. I know its just his opinion but he defiantly takes extremes and basically says that all essays, novels, political speeches that dont look like his own style of writing, are bad language.

Literature Review of the Impact of Human Resource Management on Organisational performance Organisations worldwide are under pressure today to continually improve their performance. The major trends behind these competitive pressures are globalisation, advances in information technology, and increasing deregulation of global markets (Becker Gerhart, 1996; Dany, Guedri, and Hatt, 2008). These changes have a strong impact on a countrys ability to maintain its competitiveness (Laprade, 2005). Without an efficient workforce organisations lose their ability to compete, both locally and internationally, eventually leading to poor organisational performance and thus ending up with little or no economic success (Tomaka, 2001). Unlike in the past when natural resources, technology, and capital used to be the key factors to determine the competitive advantage of the firms of one nation over the other nations, human resources today in modern times have become the most important resource for the firms to obtain strategic advantage over the other firms (Dany et al, 2008). This is beca use managers in both the public and private sector organisations regard the human resources of their organisation as its major source of sustaining competitive advantage by having the best of the best Human resource systems in place for recruiting, selecting, motivating, and efficiently managing their people (Mesch, 2010). As a result of these changes in the global economic environment business strategy, the field of human resource management is rapidly changing more than ever today (Becker Gerhart, 1996). Furthermore, among all the organisation factors which contribute to organisational performance, the human resources are now regarded as the most fundamental factor (Mesch, 2010). Recent researches on HRM show strong and positive relationship between HRM practices and organisational performance (Carlson, Upton, and Seaman, 2006; Collins Smith, 2006). Therefore, it is vital for managers to have a better understanding of the role of HRM in order to create successful organisational performance. Accordingly this chapter presents a review of the literature, relevant to this research study, on the relationship between HRM practices and organisational performance. HRM and Organisational Performance Human Resource Management Armstrong (2006, p3) defines Human Resource Management as, a strategic and coherent approach to the management of an organizations most valued assets the people working there whom individually and collectively contribute to the achievement of its objectives. Human Resource Management is, the policies, practices and systems that influence employees behaviour, attitudes and performance (De Cieri, Kramar, Noe, Hollenbeck, Gerhart, and Wright, 2008, p5). Delery and Doty (1996) assert that the HRM best practices, once identified and implemented would always produce improved organisational performance. Fox and McLeay (1992) found from their landmark empirical study of forty-nine companies, composed of companies mainly from the UK engineering and electronics sectors, strong supportive influence between six critical HRM practices in achieving successful above average sector performance relationship, over a 10 year period. These HRM practices are (ibid): Recruitment and Selection, Management Education, Training and Development, Performance Appraisal, Remuneration and Rewards, and Company-wide Career Planning. Organisational Performance A recent definition of Organisational Performance is given by Antony and Bhattacharyya (2010, p43). They define Organisational Performance as, a measure of how well organizations are managed and the value they deliver to customers and other stakeholders. According to Daft (2000) Organisational Performance is the organisations ability to achieve its objectives efficiently and effectively. Organisational Performance represents the value of the organisation in terms of the total contribution made by the efficient and effective management of its human resources (Neumann Segev, 1978). Chien (2004) strongly posits that organisational performance is composed of five major critical components. And these are (ibid, p290): Motivation Models, The Leadership, The Organizational Culture and Environment, The Work Design, and The Human Resource Management Policy. Relationship between HRM and Organisational Performance The traditional role of HRM in organisations was mainly to support the operations through managing people to win the employees organisational commitment to the goals of the organisation (McGunnigle Jameson, 2000). In consequence, HR managers had to strictly comply with the detailed procedures of personnel administration which drove the ways in which the organisations handled their human resource activities (Huselid, Jackson, and Schuler, 1997). The key HRM activities included in this regard are: recruitment, selection, performance measurement, training and development, and administration of compensation and rewards (Dany et al, 2008). In addition to performing these HRM activities HR managers have to create value for the organisations in which they work (Huselid et al, 1997). However, todays HRM focuses heavily on the organisations successful outcomes through the integration of the various HR functions (Dany et al, 2008). Ulrich (1996, p2) strongly suggests that human resources determine an organisations success in overcoming major challenges facing executives today: globalisation, value chain for business competitiveness and HR services, change, attracting and retaining intellectual capital. Together these major challenges require that HR practices create and add value that can be measured reliably (ibid). Todays top performing companies pay extraordinary attention to managing effectively the HR dimensions which affect employee behaviours: morale, motivation, attitude, commitment, etc (Cadle Yeates, 2008, p28). Each of these HR dimensions plays powerful part in determining organisational success (ibid). Modern HRM global best practices include Lawlers (1986) High-Involvement Work Systems (HIWS), Appelbaum and Batts (1994) High Performance Work Systems (HPWS), and Wood and Albaneses (1995) High Commitment Management. Research shows that these modern HRM practices have a strong and positive influence on organisational performance (Ramsay, Scholarios, and Harley, 2000). More and more researches strongly indicate that that there are positive links between HRM practices and organisational performance (Carlson et al, 2006; Collins Smith, 2006). For instance, Delery (1998, p289) asserts that, the methods used by an organization to manage its human resources can have a substantial impact on many organizationally relevant outcomes. Gerhart and Milkovich (1992) conducted studies to measure the impacts of compensation and rewards systems on the successful accomplishment of organisational goals and objectives. Likewise research study conducted by Terpstra and Rozell (1993) shows that five key HRM selection practices are linked to business profit. In his review of the key empirical studies on the relationship between HRM and organisational performance Ulrich (1997) writes that these studies investigated the impact of specific HR practices on specific successful organisational outcomes; for example, effective HR practices in training and compensation were related to business turnover, labour productivity, and organisational performance. Ulrichs (1997) review summarised that the empirical studies were based on the assumption that efficient use of human resources through best HR practices would lead to successful organisational performance. Empirical studies conducted by Huselid (1995, p635) to assess the relationship between a set of HRM practices (referred by Huselid as HPWS High Performance Work Systems, which included: extensive recruitment, selection, training procedures, formal information sharing, attitude assessment, and job design) and organisational performance of 968 large companies have shown that there is a positive relationship between HRM and successful organisational performance. The key organisational performance measures used to evaluate the high performance HRM practices in the empirical studies included: labour productivity, financial performance, and turnover (ibid). Delaney and Huselid (1996) investigated the effects of recruitment and selection, compensation, training and development, decision making, complaints and grievance procedures, promotion practices, and the combined synergetic impact of these HRM practices in 590 for-profit and not-for-profit companies. Overall, their study concluded that these progressive of HRM practices were positively associated with firm performance. Harel and Tzafrir (1999, p186), based on their extensive theoretical and empirical research as well as from the prior studies conducted by other researchers in the HR field, have identified six core components of strategic and universalistic HRM best practices that are strongly related to organisational performance. These 6 core components of HR best practices are (ibid): Recruitment; Selection; Compensation; Employee Participation; Internal Labor Market; and Training. Likewise Becker and Huselid (1999) strongly agree with the seven high performance HRM best practices put forward by Pfeffer (1998) as having strong links to organisational performance. These 7 high performance HR best practices are (Pfeffer, 1998, cited in Huselid Becker, 1999, p297): Employment Security Selective Hiring Teams and Decentralized Decision-making High Pay Extensive Training Reduced Status Distinctions Extensive Information Sharing. Each of these seven high performance HRM best practices offer options for the HR professionals to choose the appropriate ones for enhancing the organisational performance and at the same time one should remember that each of these HRM best practices form an integrated high performance HRM system (Huselid Becker, 1999, p298). Approaches to Examine HRM and Organisational Performance Relationship There are two major fundamental approaches to study the relationship between HRM and organisational performance. These are termed as: Best-Practice approach, and Best-Fit approach. Best-Practice Approach The best-practice approach claims that HRM practices are universalistic and thus any organisation can obtain enhanced organisational performance by adopting the HRM best practices for managing people in any organisational context (Boxall Purcell, 2000). Best-Fit Approach On the other hand the best-fit approach argues for a vertical fit whereby the HRM systems are integrated with the corporate strategy of the organisation for obtaining improved organisational performance within a specific organisational context (Boselie, Paauwe, and Richardson, 2003). Between these two approaches, the best-practice approach is considered to be superior by HRM professionals and researchers for examining the impact of HRM practices on organisational performance ((Hoque, 1999, p422). Cautions in Examining the HRM and Organisational Performance Relationship Although there is wide support to the idea that HRM practices lead to improved organisational performance yet there are some cautions that have to be observed. Huselid (1995), states that successful organisational performance has been obtained by high-performance firms since they were able to afford expensive HRM systems and practices and this may not be affordable to most other firms. Furthermore, leadership style could have a stronger impact over the deployment of HRM practices due to the different types of influences which the leaders can exert on their people (Becker Huselid, 2006). Organisational Performance in Public Sector Organisations The power and water sector in Oman is a not-for-profit sector. As stated earlier (in chapter 1) the power and water sector in Oman is striving for reducing its operating costs. Only those not-for-profit organisations which possess human capital resources that operate with increased professionalism and more advanced multi-tasking skills through enhanced productivity (and thus ensuring and effecting control over operating costs) can accomplish their mission successfully (Mesch, 2010). Furthermore, in the times to come, the not-for-profit sector has to inevitably pursue more efficiency and with more economies of scale in order to provide cost-effective services to their stakeholders and prove organisational effectiveness (ibid). Evaluating organisational performance in the public sector organisations is not easy and this is further compounded by the fact that measurement of organisational performance in the public sector has not been developed in the organisation theory literature (Waheed, Mansor, and Ismail, 2010). This primarily because of the following factors that are unique to public sector organisations (ibid, p330): Lack of well-defined objectives and large number of multiple objectives; Central administration; Absence of generally accepted performance indicators for measuring organisational performance; Diffused and largely fragmented responsibility because of the interdependency of the performance of the public sector organisations. As a result of which accountability is difficult to extract. Evidence from their review of the limited literature available on organisational performance in the public sector organisations show that the three most common major indicators (the other not common indicators are: relevance, and efficacy) of organisational performance used in the frameworks provided by the various researchers are (ibid, pp331-336): Efficiency, Effectiveness, and Innovation. Katou and Budhwar (2006) studied 178 manufacturing organisations in Greece to investigate the relationship between the HRM systems and policies and organisational performance. Their study used the following indicators of organisational performance from their literature review (ibid, p1226) which can also be applied to service organisations as well: Efficiency: usage of fewer resources to achieve organisational objectives; Effectiveness: achieving the organisational objectives successfully; Development: developing and building the capacity of the organisation for meeting the future challenges and opportunities; Satisfaction: satisfying all the key participants customers, stakeholders, and employees; Innovation: of products and the related processes; and Quality: enhanced higher quality of products (services). Summary This chapter reviewed the available literature relevant to this study on HRM practices that can improve organisational performance. The above review of HRM literature shows that HRM best practices is distinctly composed of recruitment and selection, training and development, compensation and rewards system, information sharing, and employee participation. Organisational performance can be measured through the successful organisational outcomes in the form of efficiency and effectiveness, customer satisfaction, service quality, and labour productivity.

Parallels in On the Road  and Easy Rider  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚        Ã‚  Ã‚   Released more than a decade apart, Kerouac's On the Road and Dennis Hopper's Easy Rider are replete with parallels. Both depict characters whose beliefs are not quite uniform with those of society; in both cases these characters set out in search of "kicks" but become part of something larger along the way. More importantly, these two texts each comment insightfully on the culture of their respective times. But all these similarities become superficial in the face of the inherent differences between the two. In pre-Beat Generation America, anyone who looked could find a whole society of people who, for the most part, were afraid to do the things they dreamed, unable to break from conformity. Kerouac saw this all around him, and with On the Road, he responds. He presents a tale of those who flee conformity successfully and without any significant negative consequences. Clearly, his audience consists of members of society who remain content with conventional societal norms, who are too squeamish to do what they want. To them he argues that they ought to assert their personal identity rather than be bound by an imposed social one, that they ought to follow their own desires rather than succumb to society's. This argument comes in multiple forms; criticisms by Dean are such a form. At one point he cries: "the moment it comes time to act, this paralysis, scared, hysterical, nothing frightens em more than what they want" (Kerouac 215). He also complains: "offer them what they secretly want and they of course immediately become panic- stricken" (Kerouac 209). These statements are part of Kerouac's argument in their critique of society's fearful attitude toward achieving desires. Sal reiterates the argument to disregard social identity when he accuses a girl he meets of an "emptiness. . .that reached back generations and generations in her blood from not having done what was crying to be done. . .'What do you want out of life?' I wanted to take her and wring it out of her" (Kerouac 243). But Kerouac's strongest argument of all for individual freedom seems to come from example. In On the Road, Sal and Dean live an amazing adventure together. Sure, they get pulled over a few times, but no real harm comes to them from any of their wild escapades. Apparently they are untouchable.

We all got along in the village. It was a nice summer day so my friend and I decided to take a walk to the river and cool off. As we approached the river some strange looking men popped out from behind the bushes and grabbed us. I had never seen someone like that before; they were pale and white. They had yellow hair and blue eyes. The men shackled us to one another and forced us to walk to where there were many other Africans in a cage. I was crying and screaming but they didn’t care. I tried to get away and they hit me with a whip so hard across my back that it bled. I had no chouse but to follow them to the coast. As I was walking I saw people from my village being whipped and beaten. They were getting whipped so bad chunks of their skin were falling on the floor. There was blood gushing from their open flesh. People are screaming for help but there’s no one to help them. Some man that was shackled tried to escape, he failed. The white men killed him. As we got to the coast there were huge wooden boats waiting for us. They shoved us into the boat, then they through us into some place below decks. We are so close together we can hardly move. Two of his siblings died from diphtheria when they were children, and one died shortly after his birth.
